Terms and Conditions

Welcome to Bharat Switch Private Limited (“Bharat Switch”). By subscribing to our smart home services, you agree to comply with and be bound by the following terms and conditions.

  • Ownership Rights: All hardware provided as part of our smart home packages remains the sole property of Bharat Switch. Customers are granted the right to use the hardware as part of their subscription.

    Usage Fees: Customers pay a subscription fee for the use of Bharat Switch’s hardware and associated services. This fee does not transfer ownership of the hardware to the customer.

    Return Requirement: Upon termination of services, customers must return all hardware in good working condition to Bharat Switch.

    Non-Transferable: Customers cannot transfer the hardware or any rights associated with it to third parties without explicit permission from Bharat Switch.

    Ownership Notification: Customers must notify any cohabitants or other relevant parties that the hardware is owned by Bharat Switch and is being used under a subscription agreement.

    Prohibition on Resale: The resale or unauthorized use of Bharat Switch hardware is strictly prohibited and may result in legal action.

    Equipment Labeling: Hardware may be labeled with ownership information and customers must not remove or alter these labels.

  • Deposit Amount: The security deposit varies based on the package and hardware provided. The specific amount will be communicated to the customer at the time of subscription.

    Refund Process: The security deposit will be refunded within 45 days after the hardware is returned to Bharat Switch in good working condition.

    Damage Assessment: Any damage or loss to the hardware will result in deductions from the security deposit. The deduction amount can range from 30% to 100%, depending on the severity of the damage.

    Inspection Procedure: Hardware returned to Bharat Switch will undergo a thorough inspection. Any identified issues will be documented, and the customer will be notified of any deductions.

    Damage Responsibility: Customers are responsible for any damage caused by misuse, negligence, or unauthorized tampering. This responsibility includes any associated repair or replacement costs.

    Conditional Refund: The security deposit refund is conditional upon the return of the hardware in the condition it was provided, barring normal wear and tear.

    Retention of Deposit: Bharat Switch reserves the right to retain the full security deposit if the hardware is not returned or is returned in an irreparable condition.

  • Installation Documentation: Bharat Switch will provide detailed documentation for the installation of smart home hardware.

    Scheduling Installation: Customers can schedule an electrician through the Switchbuddy app. The cost of installation, ranging from ₹50 to ₹150 per module, is borne by the customer.

    Technician Access: Customers must allow Bharat Switch technicians reasonable access to their premises for installation, maintenance, and necessary repairs.

    Separate Installation Fees: Installation fees are separate from the subscription and security deposit and are paid directly to the electrician performing the service.

    Unauthorized Tampering: Any unauthorized tampering or repairs by the customer or their associates will void the security deposit and warranty. Legal action may be taken for such violations.

    Maintenance Obligations: Customers are required to maintain the hardware in good working condition. Bharat Switch provides regular maintenance services as part of the subscription.

    Service Calls: Customers must allow Bharat Switch or its partners to recover hardware during disconnection or service termination. Failure to comply may result in legal consequences.

  • Proper Use: Customers are responsible for the proper use and care of the installed hardware. This includes following the user guidelines provided by Bharat Switch.

    Damage Due to Misuse: Any damage resulting from misuse, negligence, or failure to follow guidelines will be the customer’s responsibility.

    Regular Inspections: Bharat Switch may conduct regular inspections to ensure the hardware is being used properly and is in good condition.

    Immediate Reporting: Customers must report any issues or malfunctions immediately to Bharat Switch for prompt resolution.

    Responsibility for Loss: Customers are responsible for any loss or theft of the hardware. The cost of replacement will be deducted from the security deposit.

    Restricted Modifications: Customers are not permitted to make any modifications to the hardware without prior written consent from Bharat Switch.

    Training and Support: Bharat Switch provides training and support to ensure customers know how to use and care for the hardware correctly.

  • Notice Period: Customers may terminate the service at any time with a 30-day written notice to Bharat Switch.

    Hardware Return: Upon termination, all hardware must be returned to Bharat Switch in good working condition. The security deposit will be refunded after inspection.

    Breach of Terms: Bharat Switch reserves the right to terminate the service if the customer fails to comply with these terms and conditions.

    App Deactivation: Bharat Switch reserves the right to deactivate the subscribed products from the Bharat Switch app or any controlling app if the customer fails to make payments.

    Service Continuation: If the security deposit is exhausted, the customer must return the hardware and pay a penalty of ₹499.

    Unreturned Hardware: Failure to return hardware upon service termination will result in additional charges and possible legal action.

    Outstanding Payments: All outstanding payments, including subscription fees and penalties, must be settled before the service termination process is complete.

  • Limited Liability: Bharat Switch is not liable for any direct or indirect damages resulting from the use of our smart home services, including personal injury, property damage, or loss of data.

    Maximum Liability: Our liability is limited to the amount of the security deposit paid by the customer.

    External Factors: Bharat Switch is not liable for issues beyond our control, such as internet connection failures or other technical issues.

    Customer Negligence: Any liabilities arising from customer negligence or misuse of the hardware will be the customer’s responsibility.

    Force Majeure: Bharat Switch is not liable for any damages resulting from events beyond our reasonable control, such as natural disasters, strikes, or acts of God.

    Third-Party Services: Bharat Switch is not responsible for the actions or failures of third-party service providers, including electricians and internet service providers.

    Indemnification: Customers agree to indemnify and hold Bharat Switch harmless from any claims or damages arising from their use of the hardware or services.

  • Right to Modify: Bharat Switch reserves the right to update or modify these terms and conditions at any time.

    Notification of Changes: Customers will be notified of any changes through the website, email, WhatsApp, or other communication means provided at the time of subscription.

    Continued Use: Continued use of Bharat Switch’s services after changes have been made constitutes acceptance of the new terms and conditions.

    Mandatory Changes: Any changes mandated by the government of India or regulatory operations of Bharat Switch will be implemented immediately.

    Review and Consent: Customers are encouraged to review the terms and conditions periodically to stay informed of any updates.

    Dispute Resolution: Any disputes arising from changes to the terms and conditions will be resolved in accordance with the governing law specified herein.

    Binding Agreement: These terms and conditions constitute a binding agreement between the customer and Bharat Switch.

  • Jurisdiction: These terms and conditions are governed by and construed in accordance with the laws of India.

    Legal Venue: Any disputes arising from these terms and conditions will be subject to the exclusive jurisdiction of the courts in Vijayawada, Andhra Pradesh, India.

    Compliance: Customers agree to comply with all applicable laws and regulations while using Bharat Switch’s services.

    Legal Rights: Bharat Switch reserves all legal rights to enforce these terms and conditions.

    Severability: If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

    Legal Counsel: Customers are encouraged to seek independent legal counsel to understand their rights and obligations under these terms and conditions.

    Amendments: Any amendments to these terms and conditions must be in writing and signed by an authorized representative of Bharat Switch.
